DACA Renewal Update

On April 9, 2014, the USCIS announced that it expects to issue instructions and forms for those seeking to file for renewal of Deferred Action for Childhood Arrivals (DACA) by the end of May 2014. The new form (I-821D), will be used for those filing for initial application as well as those seeking renewal. While we await for the details, below of are the key points to keep in mind:

  • One can file for renewal on the revised form, which should be finalize and published shortly.
  • The current Form I-821D cannot be used to seek renewal.
  • DACA renewal application should be filed about 4 months prior to the expiration of the current DACA. The expiration date is printed on the card itself.
  • Evidence previously submitted with the initial DACA application need not be submitted with the renewal application. However, evidence of continuing eligibility for DACA should be submitted. For instance, record of continued school enrollment, criminal and immigration records should be submitted.

Now is the best time for DACA holders to consult their immigration professionals to prepare. Applicants need to be prepared to file their applications timely. The same holds for those who need to inquire about their eligibility.
